Multilingual Banking Management Application

This English translation is provided for convenience only. The French version of this document is the official, legally binding text and shall prevail in case of any discrepancy.

These Terms of Service (the "Terms") govern access to and use of the multilingual banking management application (the "Application") published by KNE – FAMILY OFFICE, whose registered office is established at 12/7 Sheinkin, Tel Aviv-Jaffa 6523114, Israel ("KNE", "we", "our").

The Application provides a service of consultation, aggregation, and automatic translation of financial information from Israeli banking institutions, into French or any other language selected by the User.

ACCESS TO THE APPLICATION AND ITS USE ARE CONDITIONAL UPON FULL, ENTIRE, AND UNRESERVED ACCEPTANCE OF THESE TERMS. BY USING THE APPLICATION, THE USER ACKNOWLEDGES HAVING READ, UNDERSTOOD, AND ACCEPTED THESE TERMS IN THEIR ENTIRETY.

If you do not accept these Terms, you must immediately cease all use of the Application.

Article 1 – Definitions

For the purposes of these Terms, the following terms shall have the meanings set forth below:

  • "Application": refers to the software, mobile and/or web platform published by KNE, enabling the aggregation, translation, and consultation of banking data.
  • "User": refers to any natural or legal person accessing the Application, whether or not they hold an account.
  • "Banking Data": refers to all financial information, balances, transaction histories, statements, and other data from the User's banking institution.
  • "Banking Institution": refers to any Israeli financial organisation of which the User is a customer and to which the Application connects with the User's express authorisation.
  • "Translation Service": refers to the automatic translation functionality of banking information from Hebrew into the language chosen by the User.
  • "Credentials": refers to the authentication elements (login, password, PIN code, etc.) used by the User to access their bank account.
  • "Personal Data": refers to any information that allows a natural person to be identified directly or indirectly, within the meaning of the GDPR and Israeli law on the protection of privacy.

Article 2 – Purpose of the Application

The exclusive purpose of the Application is to provide the User with a service of aggregation and translation of banking information available on the online platforms of Israeli banking institutions. The Application notably allows:

  • Secure connection to the online banking interfaces of the institutions selected by the User;
  • Display and consultation of Banking Data in the language chosen by the User;
  • Automatic translation of financial information from Hebrew into French or any other available language;
  • Centralisation of financial information for personal consultation and tracking purposes.

The Application is exclusively a tool for information and visualisation. It does not in any way constitute an investment service, financial advisory service, portfolio management, brokerage, or any other regulated financial service.

Article 3 – Access and Registration

3.1 – Access conditions

Access to the Application is reserved for adult natural persons (aged at least 18) with full legal capacity, as well as for legal entities duly constituted and represented by an authorised person.

3.2 – Account creation

Registration with the Application requires the provision of accurate, complete, and up-to-date information. The User undertakes to maintain the accuracy of this information throughout their use of the Application.

3.3 – Credentials responsibility

The User is solely and entirely responsible for the confidentiality and security of their Credentials. Any connection made using the User's Credentials shall be deemed to have been made by the User. KNE disclaims all responsibility in case of fraudulent or unauthorised use of the User's Credentials.

The User undertakes to inform KNE as soon as possible of any loss, theft, or compromise of their Credentials.

Article 4 – Nature and Limits of the Service

4.1 – Information service only

The Application provides exclusively aggregated and translated access to the User's financial information. KNE is not a credit institution, payment institution, or investment services provider. KNE is not authorised as such by the Autorité des marchés financiers, the Bank of Israel, or any other financial regulatory authority.

4.2 – No advice

The information presented via the Application, including after translation, does not in any way constitute financial, tax, legal, accounting, or investment advice. The User is solely responsible for their financial decisions and must, if necessary, consult a qualified and authorised professional.

4.3 – Translation accuracy

The Translation Service is provided for indicative purposes only. KNE does not guarantee the accuracy, completeness, absence of errors, or fidelity of automatic translations. Translations are generated by automated systems that may produce errors, particularly on specialised financial or legal terms.

The User is expressly informed that the official and legally binding version of their banking information is that provided directly by their banking institution, in Hebrew or in the official language of said institution. In the event of any discrepancy between the translation provided by the Application and the information from the banking institution, the latter shall prevail in all circumstances.

4.4 – Service availability

KNE strives to maintain the Application accessible 24/7, but does not guarantee uninterrupted availability. Access may be suspended notably for maintenance, updates, or in case of force majeure. KNE shall not be held responsible for service interruptions or slowdowns.

Furthermore, the accessibility of the Application depends on the IT systems of third-party banking institutions. KNE shall not be held responsible for unavailability caused by said institutions.

Article 5 – Connection to Banking Institutions

5.1 – User authorisation

By using the Application to connect to a banking institution, the User expressly grants KNE authorisation to access their bank account data on a read-only basis, within the strict limits of the service provided. The User declares and warrants that they are the legitimate holder or duly authorised representative of the bank account in question.

5.2 – User responsibility vis-à-vis their banking institution

The User is solely responsible for compliance with the general conditions of their banking institution. Some institutions may prohibit or restrict the use of third-party aggregation services. KNE disclaims all responsibility in case of breach by the User of their banking institution's conditions and shall not be held responsible for the consequences thereof, including the suspension or termination of the User's bank account.

5.3 – Technical limits

The connection to banking institutions is achieved by technical methods compliant with the state of the art at the time of development. KNE does not guarantee permanent compatibility with all Israeli banking institutions, which may modify their technical interfaces at any time without notice. KNE reserves the right to suspend or remove the connection to a banking institution without prior notification.

5.4 – No execution of operations

The Application does not in any way allow banking operations to be carried out (transfers, payments, data modifications, etc.). Access is strictly limited to the consultation and translation of available information.

Article 6 – Protection of Personal Data

6.1 – Data controller

KNE – FAMILY OFFICE, a company established at 12/7 Sheinkin, Tel Aviv-Jaffa 6523114, Israel, acts as data controller for Personal Data collected in connection with the use of the Application.

6.2 – Data collected

In the course of providing the service, KNE collects and processes the following categories of data:

  • Identification data: surname, first name, email address, telephone number;
  • Financial data: banking information transmitted by the User's banking institution (balances, transactions, statements);
  • Connection data: IP address, browser type, navigation data within the Application;
  • Linguistic data: User's language preferences.

6.3 – Processing purposes

The data is processed for the following exclusive purposes:

  • Provision and improvement of the aggregation and translation service;
  • Management of the User account and customer relationship;
  • Security and fraud prevention;
  • Compliance with applicable legal obligations.

6.4 – Data security

KNE implements appropriate technical and organisational measures to protect Personal Data against unauthorised access, loss, destruction, or disclosure. The User's banking Credentials are processed securely and are never stored in plain text by KNE.

6.5 – User rights

In accordance with applicable regulations, the User has rights of access, rectification, erasure, restriction, portability, and objection regarding their Personal Data. These rights may be exercised by contacting KNE at: office@kne-ltd.com.

6.6 – Privacy Policy

For full details of the personal-data processing operations carried out by KNE (categories of data, sources, recipients, retention periods, transfers, extended rights, and procedures for exercising them), the User is invited to consult our dedicated Privacy Policy, available at https://app.kne-family-office.com/privacy. This Privacy Policy forms an integral part of these Terms.

Article 7 – Limitation of Liability

7.1 – General exclusion

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KNE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AND SUBCONTRACTORS SHALL NOT BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES RESULTING FROM THE USE OR THE IMPOSSIBILITY TO USE THE APPLICATION, INCLUDING:

  • Financial losses suffered by the User on the basis of information consulted via the Application;
  • Errors, omissions, inaccuracies, or delays in the data displayed or translations provided;
  • Interruptions, breakdowns, or unavailability of the Application;
  • Damage caused by unauthorised access to the User's systems;
  • The consequences of decisions taken by the User on the basis of information from the Application;
  • Any malfunction attributable to the IT systems of third-party banking institutions.

7.2 – Liability cap

The User expressly acknowledges that the Application is made available to them free of charge by KNE, as a complement to the existing commercial relationship with its customer, without any consideration paid for its use. Accordingly, in any event, should KNE's liability nevertheless be recognised, it shall be limited to a symbolic amount of one hundred (100) euros, all damages combined, per User and per calendar year.

7.3 – Force majeure

KNE shall not be held responsible for delays or non-performance of the service resulting from events of force majeure as defined by applicable law, including notably cyberattacks, telecommunication network failures, natural disasters, acts of war, or governmental decisions.

7.4 – User's responsibility

The User is solely responsible for their use of the Application and the information obtained through it. The User shall indemnify KNE against any recourse, claim, complaint, or action by third parties resulting from their use of the Application.

Article 8 – Intellectual Property

The Application, its content, architecture, algorithms, interfaces, brands, logos, and any element composing it are the exclusive property of KNE – FAMILY OFFICE and are protected by applicable intellectual property rights.

The User is granted a personal, non-exclusive, non-transferable, and revocable right of access to the Application, for strictly personal and non-commercial use. Any reproduction, representation, modification, adaptation, translation, extraction, decompilation, or commercial exploitation of the Application, its components, or its content is strictly prohibited without the prior written consent of KNE.

Article 9 – User's Obligations and Responsibilities

The User undertakes to use the Application lawfully and in accordance with these Terms. The User is notably prohibited from:

  • Using the Application for unlawful, fraudulent, or public-order-contrary purposes;
  • Attempting to circumvent the security measures of the Application or banking systems;
  • Reproducing, copying, selling, or commercially exploiting all or part of the Application without authorisation;
  • Introducing viruses, Trojans, or any malicious code into the Application;
  • Using robots, scripts, or any unauthorised automated process to access the Application;
  • Providing inaccurate or false information when registering or using the service.

In the event of breach of these obligations, KNE reserves the right to immediately suspend or terminate the User's access, without prejudice to any claim for damages.

Article 10 – Modifications of the Terms

KNE reserves the right to modify these Terms at any time, notably to take account of legislative, regulatory, jurisprudential, or technical evolution. Modifications shall enter into force from their publication on the Application.

The User shall be informed of any substantial modification by electronic means (email or in-app notification) at least fifteen (15) days before they enter into force. Continued use of the Application after the entry into force of the new Terms constitutes acceptance thereof. If the User refuses the new Terms, they must cease using the Application and terminate their account.

Article 11 – Duration and Termination

11.1 – Duration

These Terms are concluded for an indefinite duration from acceptance by the User.

11.2 – Termination at the User's initiative

The User may at any time terminate their account by sending a request to KNE via the Application or by email at office@kne-ltd.com. Termination shall take effect within thirty (30) days following the request, subject to the settlement of any sums due.

11.3 – Termination at KNE's initiative

KNE may suspend or terminate the User's access to the Application, with or without notice depending on the gravity of the facts, notably in case of breach of these Terms, fraudulent behaviour, or for any legitimate reason.

11.4 – Effects of termination

From termination, the User loses access to the Application. KNE shall delete the User's data in accordance with its data retention policy and applicable legal obligations.

Article 12 – Applicable Law and Competent Jurisdiction

12.1 – Applicable law

These Terms are governed by and construed in accordance with the law of the State of Israel, subject to the imperative provisions applicable to the User under the law of their country of residence.

12.2 – Amicable resolution

In case of dispute relating to the interpretation, performance, or termination of these Terms, the parties undertake to seek an amicable solution before any judicial recourse. The User shall send their claim to: office@kne-ltd.com. KNE shall have a period of thirty (30) days to respond.

12.3 – Competent jurisdiction

Failing amicable resolution, any dispute relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Tel Aviv, Israel, to which the parties grant jurisdiction.

For Users residing in the European Union, it is specified that the above provisions cannot deprive said Users of the protection granted by the imperative provisions of the law of their Member State of habitual residence.

Article 13 – Miscellaneous Provisions

13.1 – Entirety of the agreement

These Terms constitute the entirety of the agreement between KNE and the User concerning the use of the Application and cancel and replace any prior agreement on the same subject.

13.2 – Severability

If any of the provisions of these Terms is declared null or inapplicable by a competent jurisdiction, the other provisions shall remain in force and full effect.

13.3 – Non-waiver

The fact that KNE does not avail itself of a provision of these Terms at a given time shall not be interpreted as a waiver of the right to subsequently avail itself of said provision.

13.4 – Assignment

The User may not assign or transfer all or part of their rights or obligations under these Terms without the prior written consent of KNE. KNE reserves the right to assign or transfer these Terms, notably in the context of a merger, acquisition, or asset transfer, subject to informing the User.
